The fund minister stated improvements in her recent budget announcement, but details are still thin.
A small note in the federal budget has Canada’s opposition lawyers all abuzz about what improvements the government will, in actuality, make to the Competition Act—and if improvements are also necessary.
In the recently sent budget, Canada’s Minister of Financing, Chrystia Freeland, declared there would be legislative amendments to the Competition Act as “a preliminary step” in the pipeline modernization of your competitor’s regime. In reaction, the minister who oversees opposition legislation in Europe declared analysis of the behavior was underway.
With no more details in the budget and the full budget legislation still not before Parliament, opposition lawyers opine that “low hanging fruit” will undoubtedly be resolved first.
“One is amending our price-fixing regulations to catch … buyer-side agreements,” including no-poach and labor agreements, said Subrata Bhattacharjee, national co-chair of Borden Ladner Gervais’opposition and foreign investment evaluation group.
That change was motivated by community outcry following all the large Canadian market stores last year dropped their $2-per-hour COVID-19 “hero pay” advantage for a fancy passing day. Bhattacharjee said, because of an “accident in drafting” of what the law states, cartel-type discounts on the offer side, including wages, aren’t found in Canada—unlike under antitrust regulations in the United Claims, where no-poach agreements and similar wage discounts are illegal.
“The existing legislation only grips such issues under civil normal,” said Mike Kilby, the mind of your competitors and foreign investment class at Stikeman Elliott. The Competition Bureau seeks to own them “viewed underneath the offender normal in the same way that price-fixing agreements are.”

The biggest change will undoubtedly be considering the Competition Act in mild of the electronic economy’s business landscape change. As the “modern economy” draws much attention, duty or copyright laws may be more appropriate to handle some of these dilemmas than opposition law.
The competition routine should be examined to “align with the modernized economy because it hasn’t been up-to-date in decades,” said Drew. “But it should be performed cautiously.”
If the simple repairs observed above end up being part of the budget legislation that ought to be presented that week, or whether they’re delayed for a broader upgrade to the Competition Act that’ll likely come later this season, the government hasn’t explained yet.
